Personal Care Bill Introduced in Senate - Jun 04, 2017

Congress is moving one step closer to regulating personal care products. In mid-May, S. 1113, a bill to amend the Federal Food, Drug and Cosmetic Act to ensure the safety of cosmetics, sponsored by Sen. Dianne Feinstein (D-CA), was referred to the Senate Committee on Health, Education, Labor, and Pensions, to consider before sending it to the Senate floor for consideration.

Legislation, claims substantiation, natural beauty, and crisis communications were all topics of discussion at this year’s Legal, Regulatory, and Compliance Forum, hosted by ACI and ICMAD.  The 3-day event took place earlier this month at the Millennium Broadway Hotel in New York City.  And it was clear from the outset that attendees were there to explore how best to keep the cosmetics and personal care brands they work with in good standing with consumers, with national and state governments, and in eyes of the law. 

ICMAD Announces Partnership to Make Shipping ‘Hassle-free’ - Mar 02, 2017

U.S. cosmetic and personal care trade association ICMAD has announced a new partnership with  The collaboration gives members to the non-profit access to technology that is said to simplify fulfillment, delivery, and returns with ‘the click of a button’.  Members – which include Coastal Salt & Soul, eos Products, and Face Stockholm – will have access to international facilities, same-day fulfillment and will be able to control their whole operation through a seamless inventory management platform.

With a career spanning more than 35 years, Pamela Jo Busiek has had the unique experience of participating in the beauty business from nearly every angle.  Before assuming her current role as president and CEO of the Independent Cosmetic Manufacturers and Distributors (ICMAD) trade association in 2011, she served as a retail buyer, brand developer and owner, and manufacturer CEO.  She has also held positions on ICMAD's board of directors, participating in regulatory and legislative negotiations that directly affect the industry.

Jack Black CEO Calls for U.S. Regulatory Standard in Senate - Sep 30, 2016

The U.S. Senate Health, Education, Labor and Pensions Committee (HELP) held a hearing on the modernisation of the cosmetics and personal care industry on 22 September.  It is the first time since 1974 that this committee has held a hearing on cosmetics and personal care products despite the U.S. spending $60bn on the consumer category a year.

Cosmetics May Face New Safety Regulation And, Surprisingly, the Industry is on Board - Sep 27, 2016

For those already felled by fumes from the Brazilian Blowout, it might be small consolation, but lawmakers are pushing ahead with a campaign for better oversight of the beauty business.  Despite its booming growth, the cosmetics industry in the US has been virtually unregulated.  The Food, Drug, and Cosmetic Act, adopted in 1938, essentially allowed personal care product companies to self-police.

Beware of Wen® Hair Care Products Advertised in Late Night Infomercials - Sep 27, 2016

Lawmakers have introduced two bills pushing for more regulation of cosmetics:

  • The Safe Cosmetics Modernization Act, introduced by Rep. Pete Sessions (R-TX); and
  • The Personal Care Products Safety Act, co-sponsored by Sens. Dianne Feinstein (D-CA) and Susan Collins (R-ME).

Both bills would require companies to register with the FDA, submit product ingredient lists, notify the FDA of any reports of serious side effects, and authorize the FDA to prohibit the sale of products that have been found to cause serious health risks.  The Feinstein-Collins bill would also require larger cosmetics manufacturers to pay a fee based on annual revenues.
